Welcome to Mr. Cleann Turf (the “Company”, “we”, “us”, “our”). We operate this website and store, along with all related content, features, tools, products, and services (collectively, the “Services”). Our store is powered by Shopify. These Terms of Service (the “Terms”), together with any policies referenced here (including our Privacy Policy [LINK] and Refund Policy [LINK]), govern your use of the Services.
By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Access and Account

You represent you are the age of majority in your jurisdiction and that information you provide (name, email, billing/shipping, payment) is accurate and complete. You are responsible for safeguarding your account credentials and all activity under your account. We may refuse registration, suspend, or terminate accounts at our discretion.

2. Our Products

We strive to describe products accurately; however, variations in color/appearance may occur due to device settings. Descriptions, pricing, availability, and features may change without notice. We may limit quantities to any person, household, region, or order.

3. Orders

Your order is an offer to purchase. We may accept, reject, or cancel any order (e.g., suspected fraud, pricing/stock errors). Title and risk pass on delivery to the carrier (see Shipping). Purchases are for personal/household use and not for resale or export. Returns are governed solely by our Refund Policy [LINK].

4. Prices & Billing

Prices, promotions, and discounts may change without notice. Unless stated otherwise, prices exclude taxes, duties, shipping, and handling. You authorize us (and our processors) to charge your selected payment method for all amounts due and represent you are authorized to use that method.

5. Shipping & Delivery

Delivery times are estimates only. We are not liable for delays caused by carriers, customs, weather, strikes, or events outside our control. Once we transfer products to the carrier, title and risk of loss pass to you.

6. Intellectual Property

All content and materials on the Services (text, images, logos, graphics, video, audio, product data, and their selection/arrangement) are owned by us or our licensors and protected by law. You may use the Services for personal, non-commercial use only. No license is granted to reproduce, distribute, modify, create derivative works, or publicly display any materials without our prior written consent. All trademarks, trade dress, and logos are the property of their respective owners.

7. User Content & Takedown (Copyright/DMCA-Style Notice)

If you submit reviews, photos, videos, or other content (“User Content”), you grant us a perpetual, worldwide, transferable, sublicensable, royalty-free license to use, reproduce, modify, publish, translate, distribute, display, and create derivative works in any media for operating and promoting the Services. You represent you own or have rights to your User Content and that it does not infringe any third-party rights, violate law, or contain malicious code.
Notice of Claimed Infringement: If you believe material on the Services infringes your copyright or other rights, email mrcleannturf@gmail.com with: (a) a description/URL of the material; (b) your contact info; (c) a statement you have a good-faith belief the use is unauthorized; (d) a statement, under penalty of perjury, that the information is accurate and you are the rightsholder or authorized agent; and (e) your physical or electronic signature. We may remove or disable access to the material and may terminate repeat infringers. We do not assume responsibility for third-party or user-submitted content, but we will act on valid notices.

8. Optional Tools & Third-Party Links

We may provide access to third-party tools and link to third-party sites. These are provided as-is without warranties. Your use is at your risk and subject to those parties’ terms and privacy policies. We are not responsible for third-party products, services, or content.

9. Safety & Proper Use of Products (Important Disclaimers)

Our cleaning products and power brooms are intended only for the uses described on product labels/manuals. Always read and follow all label, dilution, ventilation, PPE, storage, and disposal instructions; test in an inconspicuous area; keep out of reach of children and pets; and do not ingest. Power equipment must be used with appropriate safety gear and in accordance with the manufacturer’s instructions. We are not responsible for damage, injury, or results arising from misuse, failure to follow instructions, improper application, incompatible surfaces/materials, or combining products. You are responsible for ensuring products are permitted and used in compliance with local laws/regulations.

10. Prohibited Uses

You may not use the Services for unlawful purposes; to violate laws or rights; to upload malicious code; to scrape, crawl, or harvest data; to send spam or deceptive content; or to interfere with or bypass security or access controls. We may suspend or terminate access for violations.

11. Relationship with Shopify

Mr. Cleann Turf is powered by Shopify; however, your purchases are made directly with us. Shopify is not responsible for transactions between you and us, and you release Shopify from claims arising from such transactions.

12. Privacy

Personal information is handled per our Privacy Policy [LINK] and Shopify’s privacy terms. By using the Services, you consent to those policies and the transfer/processing of your data in other countries.

13. Errors, Inaccuracies & Omissions

We may correct errors or update information at any time without notice, including after you submit an order. We may cancel orders where information was inaccurate.

14. Right to Refuse Service & Orders

We reserve the right to refuse service, refuse or limit orders, or close accounts at our sole discretion, including for suspected abuse, policy violations, or fraudulent activity.

15. Returns, Refunds, and Exchanges

Returns and refunds are governed by our Refund Policy [LINK]. We do not offer exchanges. We may deny or limit refunds where returns do not meet policy criteria or show signs of use/tampering. Shipping costs are non-refundable.

16. Disclaimer of Warranties

EXCEPT AS REQUIRED BY LAW OR EXPRESSLY STATED IN WRITING BY US, THE SERVICES AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR THAT RESULTS WILL MEET YOUR EXPECTATIONS, OR THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE. Some jurisdictions do not allow certain disclaimers; some rights may not apply to you.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MR. CLEANN TURF AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUPPLIERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS/REVENUE; LOSS OF DATA; BUSINESS INTERRUPTION; OR COST OF SUBSTITUTE GOODS ARISING FROM OR RELATED TO THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM (OR $100 IF THE CLAIM DOES NOT RELATE TO A PURCHASE). Some jurisdictions limit liability waivers; some limits may not apply to you.

18. Indemnification

You agree to defend, indemnify, and hold harmless Mr. Cleann Turf and its affiliates, officers, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your: (a) breach of these Terms or policies; (b) violation of law or third-party rights; (c) User Content; or (d) misuse of the Services or products.

19. Force Majeure

We are not liable for delay or failure to perform due to events beyond our reasonable control, including acts of God, labor disputes, war, epidemic, governmental actions, carrier issues, or Internet failures.

20. Severability; Waiver; Entire Agreement

If any provision is found unenforceable, the remainder remains in effect. Our failure to enforce a provision is not a waiver. These Terms (and referenced policies) are the entire agreement between you and us regarding the Services.

21. Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign or transfer them without restriction.

22. Governing Law; Venue

These Terms and any disputes will be governed by the laws of the state where Mr. Cleann Turf is headquartered, without regard to conflict-of-law rules, and the federal and state courts located there shall have exclusive jurisdiction and venue, unless Section 23 (Arbitration) applies.

23. Dispute Resolution; Arbitration; Class-Action Waiver (U.S.)

PLEASE READ THIS SECTION CAREFULLY. Any dispute or claim between you and us arising out of or relating to these Terms, the Services, or our products will be resolved by binding individual arbitration administered by the AAA under its Consumer Arbitration Rules. You waive the right to a jury trial and to participate in a class or representative action.
You may opt out of arbitration within 30 days of your first purchase by emailing mrcleannturf@gmail.com with your name, order number, and a clear opt-out statement. This section does not apply to claims that cannot be arbitrated as a matter of law or to small-claims court actions.

24. Changes to the Services or Terms

We may update the Services and these Terms at any time. We will post changes on this page and, where required by law, provide additional notice. Your continued use constitutes acceptance of the updated Terms.
